Question: Who pays for the debts of the deceased person?

Answer: If a person passes away, the probate court will be responsible for seeing that all of the assets are identified and all of their debts are paid out of their assets of the decedent’s estate. If the decedent’s estate isn’t solvent and the liabilities exceed the assets of the estate then the probate court will oversee who receives the property and who will gets paid and who doesn’t get paid out of the decedent’s assets.
