Answer: Yes, you can appoint the same person as executor, guardian and trustee. The length of the term is something to take into consideration when you look at the age of the person that may be serving in that capacity. The executor position is typically a one to two year position, so that is normally a short term job. If you have a guardian they may be raising your children up until age 18m so that’s a job that may take up to 18 years to fulfill those responsibilities. When you have a trustee you have documents that you may have provided that you are going to hold assets in the trust for the benefit of your family and your children and that could be 30, 40, 50 years or a lifetime. It’s very important to identify the proper age of a person that they are going to be able to fulfill those responsibilities during their lifetime.
