Question: What happens if I become unable to care for myself?

Answer: If you become unable to care for yourself then your family is usually trying to step in to try to help you with your financial and medical decisions. If you have not made any provisions at all, then typically your family would have to go to the probate court and be appointed your guardian. Guardianship is a time consuming, lengthy, and costly process that will be carried out during the term of your disability. In order to avoid the problem of having someone be appointed your guardian, we recommend that you have a durable power of attorney which helps your family handle your financial decisions while you are disabled. We also recommend a durable power of attorney for healthcare as well as a living will so that your family can handle your medical decisions while you are disabled.
