Answer: A testamentary supplemental needs trust is a trust that is intended to provide for your special needs child upon your death. I would advise that you would not use a testamentary trust but rather a living trust in setting up that document. A testamentary trust is a trust that’s part of your will and requires the review of the probate court and can be very costly and result in a lot of administrative expense during the life of that special needs child. Then benefit then of a living trust would be that you are not subject to the probate courts supervision of that trust and I would highly recommend that you consider that.
