Must I give my agent full power over all of my property?

Question: Must I give my agent full power over all of my property?

Answer: When you execute a durable power of attorney you are not required to give your agent full power over all of your property. The power of attorney can only be effective for the property that you specifically designate within the document that you authorize the agent to have power over. In particular, if there is something you would want the agent not to have the power over you probably should be very specific so that there is no ambiguity within the power of attorney as to whether or not that was your intention or not.
