Answer: The person that is appointed executor is the person that is identified in the will that the decedent has designated to be the executor. If the person that is initially appointed refuses or fails to serve or resigns for any reason then typically the will may have an alternative executor that is identified. In the event that all of the successors that are identified in the will are unable to serve for whatever reason or refuse to serve then the probate court would use its judgment and appoint an executor to carry out the intentions of the decedent in the will.
