Answer: No, you are not required to leave property to your spouse and children. However, if you have a will and you have a probate estate most states including Ohio have rights that they give the surviving spouse that they can take against the will and take the spousal share that is provided under Ohio law so that if you are intending to disinherit your spouse you may want to consult with an estate planning attorney as to what techniques may be available to minimize the amount that can be left to your surviving spouse.
